Part I — Website Terms of Use

1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the website located at elevatedcoloradologistics.com (the “Site”), operated by Elevated Colorado LLC (“Elevated Colorado,” “Company,” “we,” “us,” or “our”), a Colorado-based trucking brokerage headquartered at 685 Citadel Dr E, Suite 290-12, Colorado Springs, CO 80909. By accessing or using the Site, submitting a form on the Site, or otherwise interacting with our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Who We Are
Elevated Colorado LLC is a licensed property broker that connects construction companies and other shippers with independent truck owner-operators for the hauling of gravel, dirt, asphalt, broken concrete, and related construction materials throughout Colorado. Nothing on the Site constitutes an offer to enter into a specific transportation contract; quotes and information provided through the Site are subject to confirmation and a separate agreement between the parties.

3. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law or regulation;
  • Submit false, misleading, or fraudulent information through any contact, quote, or owner-operator form;
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems or networks;
  • Use any automated system (bots, scrapers, spiders) to access the Site without our prior written consent;
  • Interfere with or disrupt the operation of the Site or the servers or networks used to make it available;
  • Use the Site to transmit any virus, malware, or other harmful code.

4. Requesting Quotes and Owner-Operator Inquiries
The Site allows prospective shippers to request hauling quotes and allows owner-operators to inquire about working with us. Submitting a form does not create a binding contract, brokerage relationship, or carrier agreement. Any load, dispatch, brokerage, or carrier arrangement will be governed by a separate written agreement (such as a rate confirmation, broker-carrier agreement, or transportation services agreement) executed between Elevated Colorado and the applicable party.

5. Intellectual Property
All content on the Site — including text, graphics, logos, images, and the compilation thereof — is the property of Elevated Colorado LLC or its licensors and is protected by U.S. and international copyright and trademark laws. You may view and print pages from the Site for your own personal, non-commercial use, but you may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.

6. Third-Party Links
The Site may contain links to third-party websites that are not owned or controlled by Elevated Colorado. We are not responsible for the content, privacy policies, or practices of any third-party websites. Your use of any linked site is at your own risk and subject to that site’s own terms.

7. Disclaimer of Warranties
THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that quotes, availability, or scheduling information presented will be accurate or current.

8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATED COLORADO LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

9. Indemnification
You agree to indemnify, defend, and hold harmless Elevated Colorado LLC and its owners, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Site or your violation of these Terms.

10. Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in El Paso County, Colorado, and you consent to the personal jurisdiction of such courts.

11. SMS Text Messaging Disclosures
If you provide your mobile phone number and opt in to receive text messages from us, the following applies (see Part III for the complete SMS Policy):

  • Types of messages: quote responses, scheduling and dispatch updates, load status, owner-operator recruiting communications, occasional marketing messages, and general two-way communication with our team.
  • Texting cadence: message frequency varies depending on your inquiry and any active or prospective loads.
  • Message and data rates: Msg frequency varies. Msg & data rates may apply.
  • Support and opt-out: Reply HELP for support. Reply STOP to opt out.
  • Privacy: See our Privacy Policy for more information on how your information is collected and used.

12. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted to the Site with a revised “Last Updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
